Terms of Use

1. Agreement

By creating a Zapinger account or using our service, you agree to these Terms and our Privacy Policy. If anything here is unclear, email zapinger.info@gmail.com before you rely on it.

2. What Zapinger does

Zapinger connects to your Shopify store and your WhatsApp Business Account (via Meta's WhatsApp Cloud API) to detect abandoned carts and send the recovery messages you configure.

3. Who can use it

You must be a legitimate Shopify merchant with a genuine WhatsApp Business Account, and have the legal right to message the phone numbers in your customer data.

4. Your responsibilities

This is the most important section. By using Zapinger, you agree that:

• You are solely responsible for having proper consent from your customers before Zapinger messages them on your behalf
• You will comply with Meta's WhatsApp Business Messaging Policy and any anti-spam or data-protection law that applies to you or your customers
• You are responsible for the accuracy of the Meta/WhatsApp credentials you provide, and for any message costs Meta charges directly to your WhatsApp Business Account — Zapinger doesn't set or collect those fees
• Customer opt-outs are handled by WhatsApp's own built-in controls, which Meta enforces. Zapinger does not receive or process opt-out messages your customers type (such as "STOP") — if your own templates promise that, honoring it is your responsibility
• Zapinger is not liable for messages sent as a result of your own misconfiguration, incorrect templates, or lack of customer consent

5. Plans & billing

Zapinger offers three plans, billed monthly through your Shopify account — we never see or store your card number:

• Starter — $9.99/month, up to 750 recovered-cart sends per month
• Growth — $19.99/month, up to 2,500 recovered-cart sends per month
• Pro — $29.99/month, up to 5,000 recovered-cart sends per month, plus the revenue leak detector and nightly catalog audit

All plans include a 7-day free trial, capped at 50 carts during the trial. You can cancel anytime from Settings or your Shopify billing page; cancellation takes effect at the end of your current billing period, and we don't offer partial-period refunds. We may suspend or limit your account if you exceed your plan's cart limit, misuse the service, or breach these Terms.

6. Data processing terms

Where Zapinger processes your customers' personal data on your behalf to provide the service (see our Privacy Policy for what's collected), the following applies between us:

• Zapinger processes that data only to provide the service, and only on your instructions as given through your account configuration — never for its own separate purposes
• Zapinger uses the sub-processors listed in Privacy Policy §6 to deliver the service, and will update that list if it changes materially
• Zapinger applies the technical safeguards described in Privacy Policy §9 (encryption in transit and at rest, access controls) and the retention limits in §7
• Zapinger will reasonably assist you in responding to a data subject's request to access, correct, or delete their data, including via Shopify's compliance webhooks
• Zapinger will notify you without undue delay if it becomes aware of a security incident affecting your customers' data
• On termination, your data is deleted per Privacy Policy §7, unless we're required by law to retain it longer

7. Acceptable use

Don't use Zapinger for anything illegal, fraudulent, or spammy; don't resell or share access to your account; don't try to circumvent Shopify's or Meta's own policies through Zapinger.

8. No warranties

Zapinger is provided "as is." We don't guarantee uninterrupted service, specific recovery results, or continuous availability of the third-party APIs we depend on (Shopify, Meta, and others) — outages on their end are outside our control.

9. Limitation of liability

To the maximum extent the law allows, Zapinger's total liability for any claim is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

Either of us can end this agreement at any time. If your account is terminated, your data is deleted according to the retention terms in our Privacy Policy, subject to any legal obligation to keep it longer.

11. Intellectual property

The Zapinger name, logo, and software belong to us. Using the service gives you a limited license to use it as intended — not ownership of, or access to, the underlying code.

12. Governing law

These Terms are governed by the laws of India, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of India.

13. Changes to these terms

We may update these Terms as Zapinger evolves. For material changes, we'll notify you at least 15 days in advance; continuing to use Zapinger after that means you accept the update.
